Terms of Use. The rules.

Effective 22 September 2026. These terms cover pointwoebegone.com and, as parent-company terms, both products: Moodwave and WoeShield. By using any of them you accept these terms. If you disagree, do not use them.

The short version: everything is free, limits are posted and enforced, verdicts and playlists are information not advice, and you are responsible for how you use them.

1. Who we are

Point Woebegone is the parent company of Moodwave (music mood intelligence) and WoeShield (threat detection). References to "we", "us", and "the products" mean the company and both tools together. Product subdomains may carry extra notices; where they do, those notices apply together with these terms.

2. Free means free

All Point Woebegone products are free to start and free to keep using within posted limits. There are no payments, no subscriptions, no cards, and no premium gates. Any historical mention of pricing (including old essays) is superseded by this section.

3. Eligibility

You must be at least 13 years old. Moodwave requires your own Spotify account and is subject to Spotify's terms; you are responsible for keeping that account in good standing and for disconnecting it if you no longer want analysis. WoeShield requires no account.

4. Fair limits

To keep free products sustainable, limits apply and are enforced automatically: a small daily quota on AI-assisted tagging in Moodwave, and per-IP request throttling across products. Attempting to evade limits (rotating IPs, scraping, automated farming, credential sharing) violates these terms and may lead to temporary or permanent blocking.

6. WoeShield is information, not advice

WoeShield verdicts (safe, suspicious, dangerous) are automated assessments with reasons attached. They are not professional security, legal, or financial advice, and they carry no guarantee of accuracy or completeness. Treat every verdict as a starting point: verify independently before acting, especially before moving money or credentials. We are not liable for decisions you make with or without a scan.

7. Moodwave is music information

Moodwave classifications, energy arcs, and playlist orderings describe audio features and listening patterns. They are not medical, therapeutic, or professional recommendations of any kind. Spotify data is governed by Spotify; availability of tracks, features, and API access can change without our control, and builds may vary accordingly.

8. Intellectual property

The site, copy, compass marks, and product software belong to Point Woebegone or its licensors. Your library stays yours; our tools stay ours. You may quote Field Notes with attribution and a link. Feedback you send may be used freely to improve the products, without compensation or confidentiality obligations.

9. No warranties; limited liability

Products are provided "as is" and "as available", without warranties of any kind to the extent the law allows. To the maximum extent permitted by law, our total liability for any claim arising from the products is limited to USD 100 (or local equivalent). Nothing here excludes rights you hold under applicable consumer protection law, including the Federal Competition and Consumer Protection Act 2018 (FCCPA) where it applies, or liability that cannot lawfully be limited.

10. Governing law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria, applied together with any mandatory consumer or data protection law of your place of residence (including the NDPA 2023, GDPR, and CCPA as applicable). Before any formal claim, write to pointwoebegone@gmail.com with the subject "Dispute" so we can try to resolve it within 30 days.

11. Changes and contact

We may update these terms as products evolve; material changes take effect 14 days after posting here with a new effective date. Continued use after that means acceptance. Questions: pointwoebegone@gmail.com.
